Welcome to Bound in a Book ("BIAB"). When you place an order with us, these Terms and Conditions of Business will constitute a legally binding agreement between you and us. It is your responsibility to carefully read these Terms and Conditions of Business before placing an order and/or using this website. Your use of the www.boundinabook.com website and BIAB services is contingent upon your acceptance of our Privacy Policy and the following Terms and Conditions of Business ("Terms"). Use of the www.boundinabook.com website (the "Site") will be considered acceptance of these Terms. If you do not agree to the Terms, then you may not use the www.boundinabook.com website. Please note that BIAB has the right to modify the Terms and, thus, you should review them periodically. Your violation of the provisions contained in these Terms may result in termination of our Service and cancellation of your account.

You may submit certain material to BIAB, including photographic images, as part of your use of the Service.

1. Orders. Orders are only confirmed against payment. All Products ordered through BIAB are custom made and hence are final and can only be cancelled subject to the below conditions.

2. Price. All orders are fulfilled based on the prices published on our site, or quoted via email at the time the order was placed. Prices are quoted in UAE Dirhams.

3. Payment. All payments must be made by bank transfer or via online payment link. You agree that we provide you an invoice via email. Cheques or cash are not accepted. Failure to submit a valid payment will result in refusal to perform requested service.

4. Shipping. All orders are shipped from Dubai, via courier (or delivered personally in some cases). Shipping estimates are estimates only as they are dependent on printing times and BIAB cannot guarantee that orders will be delivered by a certain date. In cases where an order is needed by a specific date, early ordering is advised.

5. Warranty and Return Policy. BIAB confirms that all books are produced professionally and with great care. As we custom design all products, only items which have been damaged in transit or which exhibit manufacturing defects, are eligible for return and replacement. Cash refunds are not offered. Please contact boundinabook@gmail.com with details of your complaint within 7 days of receipt of the goods – returns are only accepted with prior authorization and should be sent back in their original packaging. We provide no guarantee that the memory books will not tear, fade or that they are water-resistant. Any and all implied warranties and conditions relating to the services provided by BIAB or any goods delivered pursuant to those services, arising by law, are hereby specifically excluded.

6. Cancellation. In the event of a cancellation by a client at a time when the design of the book is complete but not yet sent to print, the client shall only be entitled to a refund of the printing cost. In the event that the client cancels an order before the designing of the book has started, the client will be entitled to a full refund minus a 150AED processing/admin fee, net of all charges. 

7. BIAB Cancellation. BIAB reserves the right to cancel an order at any time before sending to print. In such circumstances the client will be entitled to a full refund.

8. Delay in Submission of Materials. BIAB reserves the right to update prices in the event that the client fails to submit material within six months from the placing and confirmation of an order. 

9. Excessive Client Delay. In the event that materials are not submitted within six months of an order, BIAB reserves the right to cancel the order unilaterally. The client shall be entitled to a full refund minus a 150AED admin/holding fee, net of all charges.

10. Data Storage. We may store a digital version of your memory book on our servers so that you can reorder them. We decline liability for loss of your images or the digital version of your memory books or pictures. Any claims for compensation of costs incurred in taking the photos or compensation of sentimental value are waived up front and may not be brought by either party. We recommend you keep backup copies of all your digital data.

11. Data Protection. We warrant a high standard of data security relative to the current state of technology. Please refer to the currently effective version of our privacy policy for more details. By making use of our product and service offering you agree to the data processing described therein.

12. Copyright. You are solely responsible for the contents of data submitted to BIAB. You have to ensure that you are entitled to all copyright, trademark or other rights for the images sent to us. You alone will bear consequences stemming from a possible infringement of those rights. Should any third parties assert any claims against BIAB in connection with your order on the basis of an infringement of copyrights, trademarks or other rights, you will be liable for any such claims at your expense and be required to indemnify BIAB for any and all damages incurred, including, but not limited to, legal costs.

13. Submission of Content. BIAB reserves the right to reject submissions which contain prohibited content. Prohibited content would include: (a) Submissions which could infringe copyrights or other intellectual property rights of any third party; (b) Any submissions which are threatening, defamatory, obscene, pornographic or otherwise inappropriate or could give rise to any civil or criminal liability under any local or otherwise applicable law; (c) Any submissions which contain viruses, worms or harmful code; (d) Any submission that promotes any illegal or harmful activity. Determination as to where a submission contains prohibited content shall be made solely at BIAB's discretion and such decision is final.

14. Right of Use. By submitting your data, you grant BIAB, its affiliates and its associates the right to copy, modify, transmit and use the data in the production of your order. By placing an order for a photo book you agree to the use of certain images of the finished photobook by BIAB in its promotional or marketing materials.

15. Promotional Offers. From time to time, BIAB may offer special discounts as promotional offers. Each offer is subject to the offer details included in the offer and for the time period noted. If there are multiple offers valid at any given time, only one valid offer can be applied to a particular order and may not be combined with other offers in the same order. The discount codes must be referenced during email exchanges prior to placing your order. They cannot be applied to orders that have been previously submitted. The offers have no cash value and hence are not redeemable for cash or refunds.

16. Limit of Liability. BIAB's liability to its customers shall, under all circumstances, be limited to United Arab Emirates Dirhams Five Hundred (AED500) per order. Under no circumstances shall either party be liable to the other for any consequential or indirect losses. BIAB's liability shall be limited solely to instances of gross negligence and wilful misconduct on the part of BIAB in the performance of its services.

17. Place of Jurisdiction. This contractual relationship is subject to the laws of the Emirate of Dubai. Any disputes will be subject to the exclusive jurisdiction of the Dubai Courts.
